Many buyers are surprised to learn how much control these documents can have over how you use and maintain your home.
CC&Rs stand for Covenants, Conditions, and Restrictions. These are the rules that govern a neighborhood or community. They are recorded with the county and run with the land, which means they apply to every owner. HOAs, or Homeowners Associations, are the organizations that enforce those rules.
Why This Matters in Tucson
Tucson has many neighborhoods with active HOAs, especially newer communities, 55+ developments, and areas like Oro Valley, Marana, and parts of the Northwest. These rules can cover everything from what color you can paint your house to whether you can park a boat in your driveway or rent your home short-term.

- Meeting minutes from the last year or two

Common Questions I Hear
Many buyers ask whether they can fight the rules if they do not like them. In most cases, the answer is no. CC&Rs are legally binding. You can sometimes request a variance, but approval is never guaranteed.
Another common question is how much HOAs cost in Tucson. Fees vary widely. Some neighborhoods have modest dues, while others, especially newer or amenity-rich communities, can be significantly higher. It is important to factor these costs into your monthly budget from the beginning.
